On this last day of June, a fine, fairly mild summer day, the Frederick County Council convened to take care of the business at hand. Before we get into the nitty-gritty of tonight’s meeting , dear readers, we must start off with a message to our BFF Bud Otis. We here at the Local Yokel sincerely hope that your wife is on the mend. We are very glad to hear that our EMT and 911 services are top-notch. And we are sure that since the “everything must be privatized” majority is gone they will continue to receive the funding necessary to keep them so.  Mrs. Otis please accept our virtual flowers and very real well wishes:

Now to the business at hand. If you were following our drinking game then you had a Stars and Stripes right out of the gate:

imageAt the top of the agenda was Budget Transfers. A fairly common occurrence, quickly discussed and voted on. Should be no surprise that Billy was the main hold out. But that’s become boring to us so let’s go to the next item.

Approval of the Frederick Community College FY 2016 operating budget. Very nicely presented by FCC representative Dana McDonald I must say. She explains how the county contribution has helped the school. Most importantly, how the contribution has helped keep tuition increases low. I don’t know about you but I believe that FCC is a wonderful institution. It’s a great place to start college without the high price tag or to gain a certification or simply expand your knowledge. One would have to be living under a rock to have not heard of the crippling student debt that many young people carry. It would be very hard to imagine that an elected public official would be ignorant of the fact that the high price tag of a Bachelor’s degree is a real concern in these United States of America.

Just kidding, we totally can image who…Billy! Not only is he the only one to give this poor woman any grief, but he once again renders a presenter speechless with his inquiries. He wants to know why county residents can’t pay more in tuition if they want to! He wants to know why county residents are given any special “subsidy” at all, because folks he would love to charge them all the out-of-state rate! Every single meeting we are presented with more and more proof that Mr. Shreve is not a big picture kind of guy. I offer this article on the economic impacts of high student debt so Billy can come out of the darkness and into the light. Fortunately, the other council members see the value in an affordable post-secondary educational institution and the budget was approved 6-1.

Time for another item of common occurrence…County Executive appointments. All passed unanimously, except for the planning commission in which Billy is trying to make some point about Trout Run by voting no.

Earlier in the week we posted about item d. on the agenda. Local Yokel is not a fan of giving Mr. Smith any money at this point. Well, the only council member who agreed with us was M.C.. She argued that, “as a lawyer he should have known better.” But with 6-1 she was clearly in the minority and Mr. Smith will be receiving almost $12,000 in legal fees that he claims were associated with his duties as a former county commissioner.

A couple of items about plumbing code and an amendment to the moderately priced dwelling unit bill and then we are on to the big-ticket item: Monrovia Town Center. In short, no decision. Of course Tony would love to see this rushed through and at one point he became very agitated at Jessica for asking a question that he deemed irrelevant. Thankfully, because of the leadership of M.C. Keegan-Ayer, the council is going to review this information on the MTC dating from January 2014 to the present. The council wants to make sure they can make a thoughtful, educated decision about what has certainly turned into a nightmare for everyone involved. Even though Tony wanted a 30 day limit to this thoughtful deliberation, more reasonable heads prevailed and a decision will be deferred until September.

A few thoughts on public comment. It is very sad to us that people have to thank the county council for behaving in a thoughtful, deliberate manner. Shouldn’t that be a given? But that’s exactly what speaker after speaker did this evening. Whether Kirby or Billy want to admit it, the last four years of the board of county commissioners was a dark time in our county’s history. Citizens felt disrespected and it was really frightening to us that our county government was in the hands of a group of people who don’t really believe that government should exist at all.  Billy gave us a flash back of this disrespectful behavior when he openly sparred with a member of our community, and then Jessica, over some concerns this community member has over Route 75. Billy was consistently rude and out-of-order during this whole interaction. As one woman stated, it is embarrassing to think this man represents our county.

Another point concerning public comments is that Tony took the brunt of the criticisms this evening. He was accused of not answering communications, not properly representing his district and the people are not happy! He tried to answer these accusations in his comments, telling people to stop smirking, but it’s fairly evident where Tony’s loyalties lay. He’s got a lot of fences to mend if he hopes for another shot at this council seat.

Not sure what’s going on with Kirby lately. He needs someone to fix his microphone because once again it was very hard to hear him. His comment at the end of the meeting was very strange. He announced that he received a text that a cement truck dumped its load on the side of a road and will someone look into it? This all seemed really out-of-place. Why is someone texting Kirby with this information? And why announce it at the meeting? Does he want us to know that people call him as well? Maybe he’s tired of Billy getting all the credit.

Paul is not going to jail for you or anyone!

Today we became aware of a six page memorandum that Former County Commissioner Paul Smith sent to the County Council on June 12. It’s chock full of goodness, so we really suggest you read it. MTC_Paul_Smith_6.12.15 For those pressed for time here’s our summary:

  • He’s not signing any affidavit because he’s not going to jail for any of you jerks. And he has his 1st Amendment rights you know.
  • Even though he claims he’s not going to say anything about the FACT letter in the first paragraph, he goes on about it for the next five pages.
  • The judge was way wrong and ignorant in his interpretation of the Stevens case. Why can’t he get a judge that sees things his way?
  • He’s not guilty of any wrongdoing because you can’t prove what he did was “extreme” nor is there any “strong evidence”.
  • And these RALE people are just the worst.

  • “RALE has maligned several of the County personnel in their vicious attacks… Of course they have also waged relentless, vicious attacks against those former Commissioners and those current Council members who disagree with them. These attacks are ugly, continuous, open, and each verbal stinger is then supported by the applause and cheers of their comrades. So there you have it folks. No affidavit, the judge can’t interpret law, RALE are just a bunch of vicious jerks and let me tell you, County Council members, how to do your job. No wonder this guy couldn’t win state office.

The water vapors are weighing the council down

I do declare the humidity must be affecting some members of our esteemed county council. Tis the time of year when it is common to fall out from the stickiness that surrounds us like mud on a hog. Mr. Shreve in particular was a tad testier than usual. Makes us want to pull him under the shade of an old Magnolia that our great grand pappy planted back in 1907 and give him a good talking to. Alas, what difference would it really make?

Our first point of bewilderment with Mr. Shreve is this:

Why every week, before the pledge, does he do this? And notice he’s the only one. Does he not want to face the public? Does he worship at the altar of the American flag? What in a donkey’s backside is the meaning of this?

Now particular to this week, Billy goes right in for the no when voting on whether or not to approve the consent agenda. On the consent agenda this week were various budget transfers for departments such as: The Child Advocacy Center, Agricultural Preservation, Housing and Community Services, Planning and Development, Fire and Rescue and Community Development. His particular beef, from what we could tell since we cannot fathom getting in that head of his, was he was really bitter about the council not approving Trout Run and still not getting his budget liaison. Logic of course dictates that he then mess with everyone else’s budget. Thankfully, Billy has no one else on board with his interesting style of governance and all budget transfers were passed 6-1.

Moving on to the approval of minutes for the last three meetings. A unanimous vote! Still Billy cannot bring himself to say Aye. Must be that oppositional disorder rearing its ugly head again. A note to be made about Kirby. He did not seem to want to turn on his microphone this evening. We later discover it’s working just fine. But through all the votes we can barely hear his little “aye”. What’s up with that?

On to everyone’s favorite commission: Ethics. A motion is put forth to appoint four new members. Of course Billy isn’t going to let this go without making some kind of declaration. “It’s sad that 3 of the 5 members of the ethics commission resigned and we are in this position.” Really, really sad.

6-1 approved! Even Kirby. Billy seems to be losing all his playmates. On to Jessica and M.C.’s bill to repeal the English only ordinance. We heard some nonsense earlier in the week about Billy going on WFMD and saying this:

“You either have to stay all English or not all English. And as soon as you open up yourself, you have to provide absolutely everything.  If you have someone from the jungle of Brazil from some tribe of 20 people, and they come in and want a document translated, you have to be able to translate it for them.”

With great poise Councilwoman Fitzwater introduced the bill and we know, just know he’s going to say something and of course he does! He insisted that we don’t have to throw out old Blainey boy’s ordinance, we can just modify it. Jessica then snaps at him (Oh the humidity, but how can we blame her? I mean really.). If you have something in writing, she quipped, you can share it with me. Right now all we are doing is reading the bill. Properly chastised he shuts the microphone down.

The next order of business is something we have wanted to see happen for quite sometime. We here at the Local Yokel love our festivals. The 4th of July, In the Streets, special events at Rose Hill Manor count us in! What we do not love is seeing the mountains of trash that are full of recyclables. Our fair State passed a law requiring that all counties pass ordinances that require event organizers, within certain parameters, to provide recycling. Yay!!! Now keep in mind THIS HAS TO HAPPEN! It is a State law and Frederick County must comply. The Department of Solid Waste Management presented a lot of information to the council. And they underlined the fact that THIS HAS TO HAPPEN. Well, looky over to the left, who is going to make this difficult? That’s right Billy. He tries to make the poor solid waste people give him an estimate as to how much recyclables would be generated at a picnic or a soccer tournament. And these poor souls. Silence falls and then a response of, “There is really no way we can estimate that.” He then wants to know what private companies charge to haul this stuff away. They don’t know. His point, I suppose, is that he thinks this will put an unfair burden on people. But hey, this isn’t for little outings. It’s for events that are expecting over 200 people and take place on public property. Why can’t this man see the big picture on this or anything else for that matter? Thankfully passed 6-1.

Next oddity on the agenda. Kirby wants a lobbyist. What for? To send to Annapolis, because according to him we are missing out on millions of dollars that are either sitting in some secret bunker or being distributed to other counties. Bud rightfully asks if this is not the job of our elected delegates and state senators. Aren’t they not the ones elected to bring back money to the county? And if Kirby’s contention, for which he has no proof, is correct, then we have a problem. It was agreed that they would meet with the delegation to see if they were in fact missing out on this secret stash of cash.

It was within this conversation that our good buddy Bud almost gave us a fainting spell. He called Kirby Congressman Delauter! And oh my stars do not even joke about such a thing Bud! He quickly and quite loudly added: “Sorry about that”! Wouldn’t we all be sorry indeed?

Mad Props to David Gray

Last night’s county council meeting considered the influence of the infamous FACT Letter on the Monrovia Town Center development and zoning. A lot of people came to speak. Almost all of the speakers who do not stand to profit from the development are varying degrees of furious. The council will set a course of action on next Tuesday, June 16th at 4:30.

During public comments David Gray stood up and explained what we have all long suspected. He observed as a member of the previous (and final) Board of County Commissioners that they just did whatever Blaine Young wanted, with no consideration given to anything. It’s pretty easy to see the evidence supporting that. We’ve said before that it is awwwwwfully curious, what with all the newcomers to the county government, somehow the veterans of the previous board seem so often to be the ones lost by things like how a budget works. Thank you, David Gray, man of integrity.

We will now steel ourselves for nastiness toward what some call Turncoat Republicans. We call them independent thinkers, and we adore them. Hopefully Bud Otis will work diligently to return to the top slot in our listicle of beloved turncoats, but today our hearts sing for David Gray.

Some speakers, including former Commissioner Gray, said the letter was a political move to justify the board’s approval of the development.

“It seemed very obvious to me, to tell you the truth, that this was to pad the record,” Gray said.

RALE tries to overcome “ethics-schmethics” approach of the last BOCC

Envision Frederick County has printed a letter from Michele Rosenfield to County Council President Bud Otis regarding the Monrovia Town Center development. It is well worth reading.

Here’s a short excerpt that explains why it is so important:

This Council faces an extraordinary situation. The Circuit Court has remanded the MTC proceedings based largely upon an established violation of state ethics law – specifically the ex parte laws that are specific to Frederick County and its rezoning proceedings. State law dictates that under such circumstances the Court “shall” remand for reconsideration. The circumstances surrounding that single ex parte contact led the Circuit Court to conclude that my clients’ “strong showing” of “extreme circumstances” warranted remand of the case. My clients call upon the Council to rehear the case in its entirety not only because a violation of the state ethics laws mandates such reconsideration, but because the circumstances of this case are otherwise so egregious that no lesser option is available.

Can we please stop pretending government serves no purpose? Thanks.

Tuesday June 9 at 6:00 pm at Winchester Hall there will be a council meeting. The single agenda item pertains to considering the significance of the FACT (Frederick Area Council on Transportation) correspondence regarding the Monrovia Town Center. Another excerpt here highlights the FACT letter:

The Remand Order is only nominally about Commissioner Smith and the FACT letter.The Remand Order is more broadly intended to protect the “process” of judicial review by guaranteeing the soundness of a “record” untainted by procedural irregularities. The Court concluded that at a minimum the record is “tainted” by (1) Commissioner Smith’s conduct in connection with the FACT letter; and (2) the presence of the FACT letter in the MTC record.

Amateur diagnosis hour: Shreve has oppositional defiant disorder

You know how they say a picture is worth a thousand words? This one was floating around Facebook last night.

We do not pretend to understand this man. If we thought we did that would just frighten us. Just please. Please. As undignified as it is to beg, do not reelect him. At numerous points during this meeting he seemed to be channeling this message himself.

The meeting started with a moment of silence in which Billy prayed to the flag, like always. Making the sweeping assumption that his religion aligns with most people of his brand of politics, it seems he did not get the “do not worship false gods before me” memo. Even if we’re wrong about his personal beliefs, it remains super weird for someone who hates the government as much as he does.

If you were following our drinking game, right out of the gate you racked up some bacon vodka shots on his abstentions and stubborn utterances of all the things other than yay or nea. He thinks this is a clever way to irritate other people. He is wrong. The reaction he mistakes for aggravation is that familiar astonishment that occurs when someone lives up to extraordinarily low expectations, “Can it really be that this guy is actually as batpoop nuts as we keep saying he is? YEP. Bat.Poop.Nuts. Unbelievable.

And to prove it: nobody besides Billy, not even #kirbydelauter, wanted to get on board with allowing the historic designation that would enable the Scientologists to set up camp and maybe abuse drug addicts (as is *allegedly* their schtick, according to numerous news reports of Narconon facilities elsewhere) at Trout Run. Kirby produced the exact opposite of the “yup he’s nuts” reaction by citing the desires of his constituents. Billy could have tried something like that, but his apparent disorder compels him otherwise. (Also: Champagne toast!)

Moving forth on the agenda to the point that we were perfectly confident to diagnose the oppositional defiant disorder, there was a wacky discussion of the merits of the Clean Chesapeake Coalition, where the Democrats were concerned that it was wasteful spending, so Billy, ever the spendy liberal environmentalist (????no) hammered away at the numerous benefits of Frederick County’s membership in a fanatical fiscal responsibility twist. Like a ride on a Tilt-A-Whirl.

After some zzzzzzzzzz building code stuff…ugh. In all seriousness, laws that keep people physically safe and from the industries ripping them off by lobbying for expensive requirements are basically the best reason for not drowning the government in the bathtub, but still boring. Billy took a break from most of his favorite shenanigans for this conversation. Maybe it made him want a nap, too.

Then Billy was vehemently opposed–is there any other way for an ODD person to be?–to adding floating holidays and additional sick days for county employees, even though it was laboriously and pathetically trotted out as the most miserly way to hope to improve morale for county employees on the cheap. It passed, despite his “absolutely not.”

The end is mired in jockeying around procedure. Procedure is a really, very, extremely, consistently challenging problem for Mr. Shreve though, and this part is tough on everyone to the point that it sparkles and shines. Jerry Donald wants to suspend the rules in order to make a motion to send a letter to County Executive Jan Gardner requesting applications to the Frederick County Register of Historic Places be suspended until they can have clarification of the ordinance. Billy seizes the moment to insist they need to do the same thing with ethics. The high point is hit when he asks Michael Chomel what he would suggest and Chomel fires back in what we are so hoping was his most diplomatic way of saying, “Bugger off,” when he replies, “I don’t think it is a good idea to ask me such a broad question.” Whether that was his intent or not, we laughed our knickers off at the idea. After watching Chomel ever so patiently running remedial kinder council for him, it sure seems like the only way to hear that.

The buzz of Frederick County

It’s always interesting how two groups of people can come to two vastly different conclusions when looking at the same exact situation. This whole ethics opinion is a prime example of such a phenomenon. Jan, Bud, Jessica, Jerry and M.C. all  believe that the county should conduct it’s business openly and fairly. While Kirby, Billy and Tony believe that Kirby should be allowed to low ball everyone’s bids and snatch up all those county contracts for his own. Now, we always appreciate a good debate, but so far have not found one. Instead we been subjected to immature, inflammatory banter on WFMD and unbelievable rude behavior at a public county council meeting.

Then on this beautiful Memorial Day morning we see an article entitled The Genesis of a Relationship”  penned by no other than Mr. Delauter himself. So we reluctantly click the link, really not happy about giving The Tentacle any more web hits, to see what #KirbyDelauter has to say today. It begins with this sentence:

As you are probably aware, the buzz in Frederick County is about ethics. As it currently stands Frederick County has the same ethics laws as the state of Maryland.

Oh, we are aware. More than aware. Well, we read through the article trying to find something, anything that looks as though he has a leg to stand on. But instead…well just look:

It’s very disappointing to have this executive order come down with no notice, no meeting, and with Council President Otis backing it, without the courtesy of a phone call to me or any discussion whatsoever beforehand. What a coward we have in Mr. Otis. What a lap dog for the County Executive Gardner. His lack of leadership is the only consistent thing about Bud Otis. He is consistently bad at leading this council.

As I’ve said many times, I will continue to do what I said I would do: expose tax and spend policies, watch out for your tax money, and serve you honorably and with conviction.

Once you get through the smoke and mirrors of the Jan Gardner and Bud Otis sideshow, soon enough you will see who is a businessman/politician, and who the politician’s politician are. One looks out for others, the others look out for their own best interest.

We ALL know that Bud calling Kirby ahead of time would have only resulted in a verbal assault on Bud. There’s absolutely no other way that would have turned out. And the nerve calling Bud and Jan’s action a sideshow! We are sorry, but not allowing ONE councilman to hoard all the county contracts for himself does NOT mean that the county isn’t business friendly. And we really don’t know how in the world he can say he has behaved honorably this past week. If that was honorable behavior then we cannot even begin to guess what he would consider dishonorable. And how is he looking out for everyone’s else best interest in this situation? HOW?!

Once again we will reiterate the rather obvious point that if Kirby really wants to bid on county contracts, something he was not allowed to do as a commissioner, then he can relinquish his seat. Jan acted appropriately and totally within the law of the charter when she made an Executive Order stating that NO county executive or council member could profit from county contracts. This issue is settled. How much longer until the 3 amigos realize that and actually start doing something useful?

This week we have seen an explosion of immaturity from Councilmen Delauter and Shreve. If it had not been for the wise, mature and thoughtful words of our new BFF, Bud Otis, we may have had Delauter’s excavation company dig us a hole where we could drink our fireballs in peace. Bud’s response to the wretched, vitriolic mess that came out of #’s mouth deserves repeating:

“As President of the Frederick County Council, I have continually voiced my support for the highest ethical standards possible for elected officials. We serve the citizens of Frederick County and they deserve officials who are honest, avoid the appearance of impropriety and are open in their activities on behalf of the citizens. My perspective is in line with the overwhelming majority of citizens who want honest government processes and leadership. My perspective has not changed from when I served as Chair of the Ethics Commission.

 

“As a family man of honor with a long-standing record of ethical service to our citizens, I cannot stand by and allow fellow Council Member Kirby Delauter to make rude and offensive comments about me and other officials during a public broadcast. His recent behavior is reprehensible and warrants a public apology. This is especially important in light of Mr. Delauter’s vote in support of the recently approved Code of Civility.

 

“Regarding the recently issued Ethics Commission advisory opinion, I would like to clarify that the commission issues opinions based on its interpretation of the Ethics Ordinance. The commission does not create the rules, but it interprets rules that others adopt. County Executive Jan Gardner’s Executive Order, which I fully support, specifically addresses the procurement process and brings fairness and clarity to the citizens and those who wish to do business with Frederick County Government. As the executive and council continue to build our foundation for the future of Charter Government, we are determined to level the playing field for all those interested in bidding on projects with Frederick County Government.

 

“As I have said before, I believe the Ethics Advisory Opinion is wrong in its position that an elected county council member’s private business can bid on and perform work on county capital improvement projects and contracts. I believe that our citizens agree with me that there is an inherent conflict of interest or appearance of favoritism with an elected official bidding and performing work on county government projects.

 

“Disparaging others publicly in an emotional rush of words is not appropriate or reflective of a public servant who seeks to have the respect of his constituents. I welcome any citizens to contact me and share their opinions on my positions.”
